Sin embargo, diez a?osdespués de este Proyecto, la protección diplomática parece condenadaal ostracismo de la práctica del Derecho internacional público. Estarealidad, unida al desarrollo del Derecho internacional de losderechos humanos justifica una reformulación de esta figuraabandonando una concepción tradicional de la misma que le permitapotenciar su utilidad como mecanismo para hacer efectiva laresponsabilidad internacional, y que resulte coherente con la actualdimensión axiológica del Derecho internacional público.
