German and European Private International Law

China trade with Europe (in particular with Germany) has continually developed since China s admittance to the WTO (2001). During the same period, the Private International Law has also developed in China and in Europe. It provides the tool for the demarcation between different legal systems (whereby the observation of mandatory law sometimes leads to the simultaneous applications of rules from two legal systems). New Private International Law was instituted in Europe (including Germany) in 2009 and in China in 2011 with the entry into force of the Law of the People s Republic of China on the Laws Applicable to Foreign Related Civil Relations. In January 2013, the Supreme Court of the People s Republic of China has issued interpretations to this law. Thus, Private International Law is a hot topic both in China and in Europe.§The author Professor Brödermann (University of Hamburg and practicing attorney) summarizes the German and European Private International Law in this book. In light of the developments of Private International Law in China, this book offers an exciting look at just how similar the German and Chinese International Private Law are (to a large extent). This publication is a translation of the 5th edition of the first part of a legal textbook prepared by Chinese lawyers (Dong/Aikemu) which has introduced generations of lawyers to German Private International Law since its 1st Edition in 1989.§§Chinas Wirtschaftsverkehr mit Europa (insbesondere mit Deutschland) ist seit dem Beitritt Chinas zur WTO (2001) gewachsen. Seitdem hat sich auch das Internationale Privatrecht in China und Europa weiterentwickelt. Neues Internationales Privatrecht wurde in Europa (inklusive Deutschland) in 2009 eingeführt, in China dann mit dem Inkrafttreten des Gesetzes der Volksrepublik China zur Anwendung des Rechts auf zivilrechtliche Beziehungen mit Außenberührung . Im Januar 2013 hat der Oberste Volksgerichtshof der Volksrepublik China Interpretationen hierzu herausgegeben. Dies bekräftigt, dass Internationales Privatrecht ein brandaktuelles Thema sowohl in China als auch in Europa ist.§Der Autor Professor Brödermann (Universität Hamburg und praktizierender Rechtsanwalt) fasst das deutsche und europäische Internationale Privatrecht in diesem Lehrbuch zusammen. Angesichts der Entwicklungen des Internationalen Privatrechts in China bietet dieses Buch einen interessanten Blick darauf, wie ähnlich sich deutsches und chinesisches Internationales Privatrecht (in großem Maße) sind.
